Crown censures inadequate in Brecon Beacons case

The Health and Safety Executive (HSE) has announced it will administer a Crown Censure to the Ministry of Defence (MoD) over the deaths of three soldiers on a training exercise in the Brecon Beacons in July 2013.

While we welcome the recognition of the MoD’s gross failings in this case we do not consider Crown Censures are an adequate means by which to hold the MoD accountable. Evidence suggests there needs to be greater accountability to prevent recurrences and the best way to achieve that is to remove the legal privilege of crown immunity and let the MoD be properly accountable in law.
