Does it cost me anything for an initial discussion?

No. We will be pleased to talk to you about the circumstances of your case and the steps you can take following any poor or incorrect advice. You can call us free on 0800 124 4444 or e-mail us. You are under no obligation to continue your claim after you have spoken to us if you decide against it.

Are there are any time limits which apply?

Yes. As a general rule, the time limit is 6 years from the date that your professional advisor was negligent. For example, if your professional advisor failed to start court proceedings in your personal injury claim within the 3 year time limit, the 6 year period will start at the end of the 3 year time limit so you would therefore have 9 years from the date of your original accident to start your professional negligence claim.

How long will it take?

This can depend on what went wrong in your original claim. If a critical time limit was missed then we would expect to be able to prove that your professional advisor was negligent but if you feel that your claim was under-settled it may be more difficult to prove that your professional advisor failed to secure the appropriate level of damages in your case. It will be necessary to assess what your claim would have been worth had it been pursued with the appropriate level of skill and expertise and this can take time. However we will progress your claim as quickly as possible and you will be kept up to date regularly as your case progresses.

How much will it cost?

If you enter into a “no win no fee” arrangement with us in conjunction with a suitable insurance policy and you comply with the terms of the arrangement by co-operating with us, you will not have to pay anything if your case is unsuccessful. All details of costs that may become payable if your case is successful will be explained to you when you contact us.

Will my professional advisor be insured?

Yes. All legal professionals are required to carry what is known as Professional Indemnity Insurance cover to protect against the risk of professional negligence claims.

Will I have to go to Court?

Most cases settle before a trial but professional negligence cases are complex and so it is possible that your case will go to a trial and you would then be represented by your solicitor and your barrister who will guide you through the whole process.
